District Attorney Nola Foulston announced that the District Court has issued a Temporary Restraining Order that restrains Affordable Dream Homes, Inc. located at 3901 S. Broadway, Wichita, Kansas. from doing business until further order of the Court. The District Attorney’s Consumer Fraud and Economic Crime Division filed a Petition against the dealership on January 16, 2001, and a Motion for a Temporary Injunction on March 26, 2001. In those filings the District Attorney claims that an area consumer purchased a manufactured home from the Affordable Dream Homes, Inc. As part of the consideration paid by the consumers for this home, they "traded-in" to Affordable Dream Homes, Inc. a 1992 Skyline Colony mobile home. In the Petition the District Attorney requested the Court order full restitution to the victims, civil penalties, investigative fees and court costs.
Part of the agreement in this transaction, according to the District Attorney’s pleadings in the case, was that Affordable Dream Homes, Inc. was to "pay off" the outstanding balance owed by the consumer on the 1992 Skyline Colony home. Affordable Dream Homes, Inc. failed to pay off or otherwise satisfy the outstanding balance owed on the 1992 Skyline Colony home. The outstanding balance is more than $22,000.00.
In February of this year, a consumer complained to the District Attorney that she purchased the 1992 Skyline Colony mobile home from Affordable Dream Homes, Inc. This consumer complained that she paid the defendant in full but has been unable to obtain a valid Kansas Certificate of Title for the mobile home as Affordable Dream Homes, Inc. has still not paid off the lien on this mobile home.
In its Motion for a Temporary Restraining Order, the District Attorney states that it has now discovered that Affordable Dream Homes, Inc. is not licensed by the State of Kansas for the year 2001 to sell Manufactured Homes and/or Motor Vehicles. The District Attorney’s Motion for a Temporary Restraining Order was granted by Judge Richard Ballinger. The Order restrains Affordable Dream Homes, Inc. from taking any monies from any customers and orders the business to cease and desist from all advertising, attempts to sell and/or all sales of any vehicles, including manufactured homes, until further order of this court. The matter is currently set for additional hearing before the Court on April 13th.
