District Attorney Nola Foulston announced that the District Attorney's Office has filed a Journal Entry of Consent Judgment against Biker's Edge Cycle and Leather, LLC. (Biker's Edge), a local dealer of new and used motorcycles that does business at 1201 East Central.  The Judgment was agreed to by the parties following an investigation conducted by the Consumer Fraud and Economic Crime Division of the District Attorney's Office.

This judgment found that an employee of Biker's Edge, now terminated:

1.    Prepared, obtained and presented documents to finance companies knowing that they misrepresented amounts of down payments made by some consumers;

2.    Caused incorrect information to be provided to finance companies concerning whether or not consumers had actually made purchases, thereby securing for Biker's Edge funds from finance companies as if a purchase had been made; and

3.    Falsified down payment amounts, purchase prices, interest rates, signatures and other material information on consumer contracts in such a manner as to increase the purchase price of their motorcycle(s).

The Judgment was entered by Judge Richard Ballinger.  The Judgment restrains Biker's Edge, its agents, employees, representatives, salespersons and/or others acting on its behalf from engaging in such acts or practices in the future. The judgment orders Biker's Edge to pay restitution, penalties, fees and costs in the amount of $25,000.00. 

Foulston noted that this investigation identified a number of consumers who sustained losses and/or had agreements that contained incorrect terms and conditions.  As part of the settlement in this matter, all consumer problems known to the District Attorney have been corrected and restitution has been paid to those who experienced financial loss.

The Judgment provides an avenue for customers of Biker's Edge who made purchases between October 1, 2000 and December 15, 2001 who want to file a claim and who were not identified during the District Attorney's investigation, to file at this time.  Any such consumer should contact the District Attorney's Consumer Fraud and Economic Crime Division immediately at 383-7921.  Complaints must be filed, in writing, prior to May 15, 2002.
