District Attorney Nola Tedesco Foulston confirms the Consumer Fraud and Economic Crime Division of this office is working in conjunction with Kansas Attorney General Carla Stovall is investigating a program known as "GasUpUSA."  The GasUpUSA program claims to provide consumers with the opportunity to purchase prepaid gas bonus cards at a discount price and that these cards can be used at a majority of gasoline outlets across the United States.  According to information provided by GasUpUSA, the program also provides several other benefits such as discounts at hospitals, pharmacies and other businesses.  Individuals can enroll as a "Member" and any additional fee is waived if the person wants to be a "Independent Representative" for a total price of $149.99.  According to the company's materials, an "Independent Representative" participates in the opportunity to earn and receive commissions and certain free gas bonuses from the sale of memberships.

This program is currently being promoted in various areas throughout the State of Kansas, including the Sedgwick County area.  Both offices have received a number of citizen inquiries.

Foulston and Stovall are reminding consumers to be very cautious about personal involvement or investment programs that promise significant returns in exchange for recruiting other into such a program.  Consumers should carefully confirm all information about such opportunities.  They would be wise to review any business opportunity with their private attorney before committing their own funds or soliciting funds from others.  Such a review will help protect citizens from possible violations of Kansas law.  Foulston notes that no formal legal action has been taken against those involved with the GasUpUSA program and that no final determinations have been made that the program violates Kansas law.
