Resolution Amending an Order of the Local Health Officer

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF SEDGWICK COUNTY, KANSAS AMENDING AN ORDER OF THE LOCAL HEALTH OFFICER
WHEREAS, the Board of County Commissioners of Sedgwick County is authorized by Sections 37 and 38 of House Bill No. 2016 of the 2020 Special Session of the Legislature to review, amend, or revoke orders issued by the local health officer; and
WHEREAS, the Board of County Commissioners of Sedgwick County has voted to approve a resolution that amends an Emergency Public Health Order of the Sedgwick County Local Health Officer issued by the Sedgwick County Local Health Officer on July 21, 2020 (“local health officer’s order”).
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF SEDGWICK COUNTY, KANSAS that:
SECTION 1. Section I.3.a. of the local health officer’s order is amended to state as follows:
Persons age eleven years or under; children age two years and under in particular should not wear a face covering because of the risk of suffocation;
SECTION 2. Section II.5. of the local health officer’s order is amended to state as follows:
Section 5.d.i. of Executive Order No. 20-34 is amended to state as follows: Bars and night clubs shall be closed to the public, except that curbside and carryout services are allowed. For purposes of this Order, “bars and night clubs” means premises which are open to the general public where alcoholic liquor by the individual drink is sold and which derive less than 30 percent of gross revenue from sales of food and non-alcoholic beverages for consumption on such premises in a 2-month period.
SECTION 3. Section II.9 is added to the local health officer’s order and states as follows:
Section 6.d.iii. of Executive Order No. 20-34, which had required the closure of certain swimming pools, is not incorporated into this Order.
SECTION 4. Section VII. of the local health officer’s order is amended to state as follows:
This Order is effective at 12:01 A.M. on Friday the 24th day of July, 2020, and shall remain in effect through 11:59 P.M. on Friday, the 21st day of August, 2020, unless it is amended or revoked, as indicated within Section IV of this Order.
