Resolution Rescinding Resolution No. 105-2020 and Amending an Order of the Local Health Officer

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF SEDGWICK COUNTY, KANSAS RESCINDING RESOLUTION NO. 105-2020 AND AMENDING AN ORDER OF THE LOCAL HEALTH OFFICER

            WHEREAS, the Board of County Commissioners of Sedgwick County is authorized by Sections 37 and 38 of House Bill No. 2016 of the 2020 Special Session of the Legislature to review, amend, or revoke orders issued by the local health officer; and

            WHEREAS, on July 22, 2020, the Board of County Commissioners of Sedgwick County approved Resolution No. 105-2020, which amended the Emergency Public Health Order of the Sedgwick County Local Health Officer issued by the Sedgwick County Local Health Officer on July 21, 2020 (“local health officer’s order”); and

            WHEREAS, the Board of County Commissioners now desires to rescind Sedgwick County Resolution No. 105-2020 in its entirety and affirm the order by the Sedgwick County Health Officer with certain amendments.

            NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF SEDGWICK COUNTY, KANSAS that:

SECTION 1.  Resolution No. 105-2020 is hereby rescinded.

SECTION 2.  Section I.3.a. of the Sedgwick County Local Health Officer’s order is amended to state as follows:

Persons age eleven years or under; children age two years and under in particular should not wear a face covering because of the risk of suffocation;

SECTION 3.  Section II.9 is added to the Sedgwick County Local Health Officer’s order and states as follows:

Section 6.d.iii. of Executive Order No. 20-34, which had required the closure of certain swimming pools, is not incorporated into this Order.

SECTION 4.  Section VII. of the local health officer’s order is amended to state as follows:

This Order is effective at 12:01 A.M. on Friday the 24th day of July, 2020, and shall remain in effect through 11:59 P.M. on Friday, the 21st day of August, 2020, except that the curfew relating to businesses licensed to sell alcohol for on-premises consumption shall go into effect on Saturday, July 25, at 2:00 A.M.

SECTION 5.  This Resolution is effective upon its approval by the Board of County Commissioners:
