A $63,209.69 default judgment was entered against a swimming pool maintenance business

WICHITA, KS – A $63,209.69 default judgment was entered against a swimming pool maintenance and repair business for engaging in unconscionable and deceptive acts under the Kansas Consumer Protection Act (KCPA). The matter was investigated by the Office of the District Attorney’s Consumer Protection Division after receiving a consumer complaint against Wesley Petty, aka Jon W. Petty, doing business as Huckleberry Pool and Huckleberry Maintenance LLC.

The Consumer Protection Division alleged in case number SG-2025-CV-002596 that Wesley Petty violated the KCPA by recommending a particular saltwater pool system, claiming that it was his favorite salt system, was easy to operate and to maintain. Petty charged the Sedgwick County consumer $1,659.00 for the saltwater system itself. When the system later malfunctioned and had to be replaced, the consumer learned that Petty had installed an inferior system costing about $600.00.

In the judgment, the Court ordered Petty to first refund the consumer $2,012.69. The Court then ordered Hutchison to pay investigative expenses, civil penalties, and court costs for a total judgment of $63,209.69. The Court also prohibited Petty from doing business in the State of Kansas until the judgment is paid in full.

The District Attorney reminds consumers to exercise care when choosing a pool contractor. A request for a substantial payment before performing work may be a red flag indicating that the contractor is under-capitalized.

The default judgment was ordered on December 9, 2025, by Judge Kevin Smith. The case was investigated by Jimmie Merrick of the District Attorney’s Office.
